Nearly 600,000 Voters Subject to Possible Caging in Ohio

    How many voter-registration mass mailers are "returned to sender" in the run-up to Election Day may determine how many Ohio residents are eligible to vote.

    Ohio election officials are sending out a mass mailer stamped "do not forward" to all registered voters today (Sept. 5) with an absentee ballot application and other important notices for Nov. 4.

    What's important here is not so much what's going out as what's being returned to sender.

    Unbeknownst to the would-be recipients, the same mailer - just 60 days before the election - has the potential to determine their eligibility to vote, challenged not by election officials but by partisan opposition.

    A similar mailer in March netted nondeliverable mail from almost 600,000 registered voters in just five Ohio counties who could now have their ballots thrown out for voting under the wrong address.

    The National Voter Registration Act prohibits any state from purging names from the voting rolls within 90 days of an election.

    The law doesn't, however, preclude mass partisan challenges on or shortly before Election Day - known as voter caging - based on the same returned envelopes from state-sponsored mailers like the ones in Ohio and others going out across the country.

    In 2004, the year the national election hinged on results from Ohio, the Ohio Republican Party challenged 35,000 voters based on returned mail from the GOP's own friendly reminder notices. From 2004 to 2006, Republicans challenged 77,000 voters this way nationwide. A consent decree issued in 1982 and amended in 1987 enjoins the GOP from instituting "ballot security programs" that focus on minority voters.

    No evidence so far suggests Republicans - vote caging is essentially a GOP sport - have mounted a caging campaign this year. Yet, in July, Franklin County Election Director and County GOP Chairman Doug Preisse told reporters he didn't rule out challenges before November, particularly because of increased home foreclosures, which would make failures to change address on voter registration records more common.

    A challenged voter will likely cast a provisional ballot, which often requires voters to return to election divisions to prove their identity and address. Nearly a third of all 1.6 million provisional ballots cast in 2004 were thrown out.

    Voting-rights groups don't oppose voter-roll housekeeping, but they cite the federal law as evidence that executing it so close to the actual election isn't fair.

    The fraud that voter caging purportedly roots out is relatively rare, although vote solicitors working for the liberal group ACORN, the Association of Community Organizations for Reform Now, in 2004 and again this year were accused of submitting false registration forms. Ohio is one of five states where ACORN employees have been investigated and, in some instances, jailed over submitting false voter registration forms.

    Unrelated to ACORN, the Web site GOP.com cites two voting-fraud court cases in Ohio, both focused on individuals casting a second ballot intentionally.

    On Nov. 1, 2004, voter-rights groups reacted and challenged the partisan caging in Ohio all the way to the U.S. Supreme Court in just two days but lost in a final-hour appeal. This year, they want to be as proactive as possible, said Donita Judge, Ohio staff attorney for the nonprofit Advancement Project.

    "A single returned piece of mail is not a reliable basis for challenging the right to vote," Judge said. "Mail may be returned for many reasons, including errors in the database from which the mailing is derived, errors in the mailing labels, failure to include an apartment number or poor matching criteria."

    Since 2005, Ohio state law has required a non-forwarded mailer 60 days before each federal election. The suspicious part about the law, Judge said, is that it's set to expire after the November election.

    But it's not all about throwing votes out. Another aspect of Ohio's reformed election law is that it opens a window between Sept. 30 and Oct. 6 when voters can register one minute and cast a ballot the next.

    That's generally seen as a benefit for Democrats this year since the new registrations refer mainly to 400,000 or so resident college students in Ohio. Obama holds a 2-to-1 lead over McCain among 18- to 34-year-olds, according to a Washington Post-ABC News poll released last month.

    Following a statewide mailer similar to the one going out today, before the Ohio primary in March, the Advancement Project obtained the lists of returned notices through simple public records requests. The organization requested records from five urban Ohio counties - Cuyahoga, Franklin, Hamilton, Lucas and Summit.

    The total came to 600,000 names out of 3 million voters, amounting to 19.7 percent of all registered voters.

    Sally Krisel, director of the Hamilton County Board of Elections, said the high percentage was misleading because the mailer in her county included those on the inactive voter roll. Considering only active registered voters, the county received about 5 percent returned in March, she said.

    Inactive voters, tagged for possible removal, are given two years to cast a ballot before they can be removed from the rolls. None of the returned, 60-day notices are used for that purpose, Krisel said.

    "We have not purged anybody this year," she said. "In big counties, we're often carrying a lot of inactive voters."

    In Franklin County, the March mailer went to all registered voters as well. Out of 780,000, more than 150,000 notices were returned. Those voters are now excluded from receiving another notice this week, said Ben Piscitelli, spokesman for the Franklin County Board of Elections. The only public records request for the list so far came from the Obama campaign, Piscitelli said.

    Meanwhile, the sweeping Ohio election law loosens the rules around challenging voters. It also strips much of the ability of voters to know they are being challenged and defend their right to vote before an election judge.

I think this comes under the

I think this comes under the heading "harassment." Of course you don't want people voting twice, or people who aren't proper residents to vote. But it doesn't look like these activities do anything to prevent either of those occurrences. I'm trying to think of what legitimate purpose this does accomplish this close to an election. The "do not forward" part, which is of course the crux of the activity, could easily result mislead election officials for reasons other than the ones mentioned by Ms.Judge. For example, a friend of mine is living in a temporary residence about 1/2 mile from her home which is being repaired after a fire. The fact that she is having her mail forwarded to her temporary address now has her worried. Should she really be deprived of a ballot because she moved but thought it was too inconvenient to inform every entity that sends her things that she's moved a half mile for a month? I can usually tell a Republican mailer just from the tired typefaces and I'll bet I'm not the only one. "Return to Sender" is what I put on mail I don't want to get again. Plus, can doctrinaires really be trusted to be completely forthright with the process? Is there a security piece that guarantees every item of evidence is real? How do you audit the trail of 600,000 pieces of returned mail for authenticity? Having to accept mail from the Republican party in order to confirm you exist is ridiculous.

Here we go again, and then you have so-called progressives wanting to vote for McKinney or Nader, who don't have a chance to win. Those are going to be thrown away votes, possibly tilting the election to Palin (McCain). Repugnantcan elecdgtion officials will try to do these dirty tricks again, just like 2000, 2004, and 2006, where at least the vote was so overwhelmingly for democrats, that their dirty tricks didn't matter, though some Dems lost races because of Repugnantcan shenanigans. There's a lot of uninformed and downright stupid people out there who will again vote against their best economic interests and vote for Palin because she's a kick-ass woman, and that's all they care about! So, NO ONE who has a progressvie thought in their head, no one calling him or herself a Democrat, should throw away their vote, or sit at home on election day. This election is as crucial as was the one in 1932, and possibly the most crucial if you care about the Constitution, the system of checks and balances, and a judicial system that takes the meaning and spirit of the Constitution and the Bill of Rights into each judgment made. A Palin/McCain victory means more war (McCain says 100 years!), more progressive legislation NOT passed, more of the same old stuff we've had from Bush for the last eight years. Unite and fight and vote for Obama, and don't let them not let you vote!

We can't know if the number

We can't know if the number "600,000 voters" is accurate, but we can know it is essentially true that in several key population centers, votes were not accurately counted for selected local, state and federal Democratic candidates, and many voters did not getto vote because of cadging. There's no reason to think the same people who manipulated the votes since 2000 won't do it again. And unfortunately, election system reformers are so blindly "non-partisan" that they won't say the ugly truth even though they know it: namely that since 2002 Republicans have so manipulated our vote counting systems with paperless machines and rigged tabulators that millions of votes have been lost or fabricated. And it is generally acknowledged by elections insiders that John Kerry easily won in Ohio in 2004, and that Al Gore easily won in Florida in 2000. Even in 2006 the GOP operators stole a landslide vote, leaving us with a crippled Congress, unable to pass any meaningful legislation. In 2008, if we let the corporatists get away with it again, McCain/Palin means "President Palin" since the fragile John McCain cannot withstand the stresses of the job (or worse). A President Palin will surely be completely controlled by corporatists in our permanent government -the oil and media barons, plus State Department & the Pentagon careerists). These are people who honestly believe the America people cannot govern themselves, and will probably never willingly let go of power. One hopes this isn't true, but what is surely true is that they must be stopped at all costs from stealing this next election, again.

Since it is pretty certain that a lot of Purging of the voter rolls will be done prior to the election the best defense is a good offense. It is also pretty certain that they will not purge Republicans. So, confuse the hell out of them. Change your Party affiliation from Democrat to Republican ! Confuse the hell out of them ! I foresee a nationwide state of emergency being declared before November 4th, bringing with it Martial Law. This essay takes me back to August 1934 in Germany, when I was an almost 14-year old boy listening from a concealed place in the basemewnt of our schoolhouse to Nazi Storm-Troopers "counting" the ballots in the then "plebiscite" engendered by Hitler to overcome the strictures of the then German "Weimar" Constitution. I heard one Storm trooper tell his underlings that "We have to make it come out so that there will be fourteen "NO" votes, because that's how many Jews voted today". And that is how it came out, of course. Well, we can sit and complain about what is happening or we can use the power of the internet and personal networking to remind everyone we know that it is their responsibility to contact their county voter registrar if they have changed addresses since the last time they voted. As voters we need to take some personal responsibility but nudges and reminders are good.

As an Ohio voter, I recently received a notification from my local BOE marked "RETURN SERVICE REQUESTED". I assume all other registered voters in my county received the same one. Now we are all about to receive another mass mailing from BOEs stamped "DO NOT FORWARD". Why? There is no legitimate function of these mailings. It is clearly nothing more than an antidemocratic method to purge voters from the rolls for partisan purposes. Maybe if we had Independents on the BOEs, instead of only the two gangs that run this country (into the ground), dirty tricks like these (at public expense) would not happen.


I know I'm not the only one

I know I'm not the only one who notices that controversial activities at the polling places always happen in some heavily populated state with a large number of electors, one that is expected to be a close race on election day. And the beneficiary always turns out to be a Republican. Ohio's where they sank Kerry last time--banning many likely Democratic voters (notably black) from the polling booths. Gore ran up against all sorts of chicanery in Florida, with the Supreme Court administering the coup de grace. Odd that nothing unusual is ever noted in a less-populous state, like maybe one in the red states in the Bible Belt--one that already is a Republican given. When they say sent out by election officials and note just five particular counties, I presume we're talking about the offices of five Republican county auditors or whatever equivalent supervisors of elections are handling such things in those counties. Someone's obviously figured that most of the people of who have lost their homes during the mortgage crisis or otherwise been dispossessed are low-income voters--probably Democrats. The article says: "In Franklin County, the March mailer went to all registered voters as well. Out of 780,000, more than 150,000 notices were returned." That says quite a lot. That's about 1 in 5 registered voters. Were these counties chosen for their demographics? Are they counties with comparatively high or low average family incomes? More Blacks and Hispanics than neighboring counties? I, for one, would be interested to know.


One of the ways the

One of the ways the Republicans stole Ohio in 2004 was to have the votes counted in Tennessee, on a computer that had GOP software. That was not the only way they stole the election. There were long lines in precincts that tend to vote Democratic -- with a wait of up to 10 hours. Talk about unpatriotic!


Every voter of every State

Every voter of every State should personally check with his/her Board of Elections office to make sure the registration is proper and for the correct address. Every voter should also make certain that his/her vote will be certified and/or that there is a printed paper record of his/her vote. Every person in every State should also demand that his/ her Representative support Dennis Kucinich's resolution to IMPEACH Bush/Cheney this coming Wednesday.

I urge all Ohio voters who recently changed their addresses to check with their local Boards of Elections. If there is any problem, go there in person and confirm that you are registered. If there is still a problem, contact your councilperson, state delegate, or state senator (whichever one is a Democrat). If you still have problems, call the Governor's office. This election is over. Elections in the USA have been over since the Enron/Halliburton/Exxon/Diebold coup of 2000. The US is an oil dictatorship, where the oil producers call the tune and the oil consumers get to dance. But Americans are FREE. FREE to be utterly ignored by all three branches of government. American Idol is popular because that's as deep as Americans get: "oohh, I like her, she's a babe. I don't like him, he's arrogant. I don't like her, she's uppity. I like him, he was a hero 35 years ago." We elect leaders on simple like/dislike. Never mind policy, the Constitution, or justice. The GOP figured out after the Nixon-Kennedy debates that your candidate has to look good on television, so they began to groom Reagan for the job. It's been showbiz ever since. Enjoy the show, er, I mean the 'election'.


Preemptive voting.

Preemptive voting. Re-register and request an absentee ballot. Vote ahead of election day with a mail-in ballot -- giving a paper trail for re-count purposes, and possibly heading off the effort to disenfranchise you. Voters have to plan ahead to assure that they will be allowed to vote. Voting ahead will allow you the luxury of NOT having to stand in line at the polling station. Any challenge to your eligibility will have to be done ahead of the official election day, giving you the opportunity to fix the problem, or draw attention to the purging effort underway. Preemptive Voting -- it's the only way.

i'm amused: all you have to

i'm amused: all you have to do is notify the registrar when you move and you can still vote. if you don't do it, you can't vote. it's the same law in all 50 states, with minor variations. .... yet some people see a vast conspiracy when all it that is happening is that the citizens involved don't care enough about their vote to exercise it properly. the same folks get upset that interested parties take steps to ensure that only valid voters get to vote. why would you be against that, unless you support illegal voting?


As a federal worker now

As a federal worker now living outside of Ohio, I am eligible under Ohio law to vote absentee, using my old address (Ohio state employees and members of the military have the same right under Ohio law). So as a legally registered voter, it looks like I will likely be challenged by the same forces who did massive challenges in 2004, including challenges of voters I registered in 2004 (I lived there at that time and worked on voter registration drives). Interestingly enough in those drives, when someone answered the door who did not live at that address (e.g., visiting, caring for a sick relative, etc.), they actually let us know they lived elsewhere and if not registered, would register for their home address. Unlike the lies spread by a certain lump-of-dough-headed texan, people actually seem to be honest when registering to vote! When that dough-headed texan's party challenged voters in primarily African American communities in Ohio, they had sent out their own return requested/do not forward letters to new voters in those communities - but their computer program was messed up and letters went out with names attached to the wrong addresses (error or on purpose???). The party then sent lists of allegedly "fraudulent" voters to the county Boards of Election. Needless to say, hearings showed that these challenges were baseless. Some of the voters were serving in the military overseas, others refused the letters, wrong addresses, etc. The challenges were tossed. However, this new method which the lame duck legislature passed and lame duck governor signed in 2006 is much more serious. It needs to be fought - I know I will be contacting my BOE about this and seeing what else I can do to help challenge the legality of this attempted election theft.


This would be a great chance

This would be a great chance for Democrats in Ohio to get out and make sure that everyone gets registered or does a change of address before the election. It is, after all, the duty of the voter to keep his/her precinct aware of any changes and to make sure they've got their voter registration card. If a person actually cares who rules over us, they need to be able to vote in November.


One of the most insidious

One of the most insidious results of this, as Greg Palast has pointed out in his book "Armed Madhouse" (www.gregpalast.com), is the fact that soldiers currently serving in Iraq, many of whom are against the war and against the Republicans who sent them there, will be caught in the "cage", since they are not currently living at their home address. The US Attorney General scandal about illegal firing of state officials is ALL about this--Alberto Gonzalez is Karl Rove's buddy and saw to it that attorneys who refused to prosecute supposed "fraudulent voters" (those who had mail returned or who happened to share a name, like Jose Garcia, with 200 other people in a given area) were fired. These firings have never been revoked--even though they were clearly illegal. Instead, there have been "temporary appointments" of election officials and attorneys who are known to be working for Karl Rove in swing states until after the election.

I just made a large donation to Greg Palast at www.gregpalast.com, and suggest all of you worried people do the same. He is truly trying to alert everyone to this very real problem of dirty Republican tricks. On a video with Bobby Kennedy done last year, he mentions that when soldiers go off to Iraq and use their home address as their voting address, the Republican "return to sender" mail arrives at their home address and they are not there, so when they vote from Iraq they have no idea their vote was challenged and tossed out. This is a very serious crime, and the criminals are now serving as Bush-appointed district attorneys in various states so they won't get jail sentences for their crimes. Please people help register as many people as you can, and have everyone check that they are duly registered to vote.

Republicans can only pull this off when a Republican is the Supervisor of Elections or a similar role in a given county and there are no non-Republicans in place in any sort of oversight situation to even see what's going on. So *run* for local office, people. RUN FOR LOCAL OFFICE. Or get behind someone you can support and who you think can win. It's the only way. It's like with talk radio. A little seed planted in the 80s - rescinding of fairness doctrine - bloomed magnificently for them. Same here.

I agee with 'THE ELECTION IS OVER' Well said..It is disheartening to think our election process has come to this...The issues are not what this election is about. I believe we need healthcare for all U.S. citizens. The U.S. spends billions around the world to help those less fortunate nations,but when it comes to healthcare, the answer is : let the market decide how or if you will be covered. In Maryland, where I am an

In Maryland, where I am an election judge, the general rule is to support the voter. If he or she is listed on the voter rolls at a different address, he or she can cast a written, provisional ballot at the new polling place. We tell the voter that the names on that ballot may not be the same as those in his or her home district, but they will have the same names at the state and federal level. If the voter is registered in the system and has a voter ID number, even though at a different address, the vote will be counted. The voter must provide proof of his or her current address. Remember, this is the way we do it in Maryland. Other states shoulc more or less follow the same rules./

Shortly after it's publication on Friday, Ohio SoS Jennifer Brunner issued a directive saying these notices can not be used as the sole basis for caging. However, the situation still exists as a real possibility in other states. And still nothing closes the door in general to partisan caging in Ohio.

My letter from from the board of elections in Ohio said "change service requested," which means this: Change Service Requested: Separate notice of new address or reason for nondelivery provided; in either case, address-correction fee is charged; mailpiece is not forwarded or returned but disposed of by the Postal Service. Watch out people & spread the word! I'm in southwest Florida, where foreclosure notices have been running two pages a day in the Naples Daily News...This mailing hit my mailbox in Collier County, FL on Sat. Sept 8, 2008. The mailing itself is even more problematic, as it leaves the impression that the mailing information is pulled from voter registration lists. The subject of the letter, for example, lists my correct Congressional District, has a "voter ID#" field that I can't identify, and shows my party affiliation as "undetermined" even though we must declare a party here in Florida if we want to vote in a primary.


I hope this letter enrages

I hope this letter enrages every black person who can read. THEY WILL NOT LET YOU IN THE white HOUSE. So you MUST forcibly vote your way in. It is THEY'RE greatest fear. Oh, THEY consider all democrats black. So let's give THEM a good dose of the black plague in November.


Some countries have strong

Some countries have strong arms threatening people before they go into a voting booth. Other countries won't allow certain candidates to be on the ballot. We disenfranchise voters electronically: we manipulate the machines, we manipulate the voting laws, we write vague laws, and somehow the great majority of disenfranchised voters just happen to be Democratic! Herbert Hoover would be proud!


I live in Ohio. My husband

I live in Ohio. My husband and I protested in Columbus (Ohio's state capital) in late 2004, and again in January 2005. (Ever been to Ohio in January?) I could count the protesters... yes, there were more than a few, but it wasn't thousands. WHERE WAS EVERYBODY??? It almost seemed that only Senator Barbara Boxer of California (yes, California, not here), was the only person concerned about that vote count. It has now been PROVEN that the Ohio vote was stolen then; that John Kerry should be the current President. Of course, where is that info? Of all the "urgent" e-mails I receive, the vote seems the "least" urgent. Some people assume that, because there is a Democrat as Secretary of State, that Ohio is safe. Not so. We still have plenty of hanky-panky concerning the vote. On my street there are so many "for sale" signs; people who have had to move because they couldn't afford both the mortgage and the doubled or tripled natural gas prices (funny because there is natural gas right under my city). Many of these people may not realize that when they move, they must also change their driver's license to show a current address, even if they just got a new license and they will have to pay the full price for a new one. My parents, who are not allowed to drive, had to be taken to a local Bureau of Motor Vehicles for a picture I.D. But how many people are on the streets making sure that everybody has a correct address on their picture I.D., and assisting them to get the I.D. if they don't? This is the biggest form of hypocrisy ever. In 2004, I watched as the woman directly in front of me in the voting line was denied her right to vote because of her address of residence. But when I went to my County Democratic headquarters a few days ago, they didn't even have the "Obama-Biden" signs for my front yard. Come on! It is legal to fill out an absentee ballot in a few weeks. These people already have signs, even billboards on streets, for local Democrats, but they are dragging their feet. If anybody cares about what will happen in this coming election, they need to do something NOW.

I wonder if these vote-cagers even send their notices to the correct addresses. I get the feeling they just send mail to the wrong address in minority districts and then bump people from the rolls for the crime of not having lived in a place they never claimed was their address.


Ohio has historically been

Ohio has historically been one of the most corrupt states in politics. The GOP has been guilty of voter fraud in many instances in that state. For instance: the marriage amendment on the ballot in 2004 was rigged. ..in Clermont county the ballot was, in some areas, altered to have only one option available... the basic fundamental building blocks of democracy are of no concern to this type of partisanship.

Now is the time for every voter anywhere in this country to verify that they ARE eligible to vote. You would think that, in a democracy, that would be a given. Imagine, having to verify that YOU ARE ELIGIBLE to vote NOW because elections have become so very crooked. Other democracies would be ashamed by this state of affairs. BE AFRAID...BE VERY AFRAID!!! THE ELECTION MAY BE STOLEN AGAIN!! The Republicans are at it again.....caging, but this time with a new twist. I was listening to a podcast of the Thom Harmann show from September 11. 2008. Lee Rayburn from Mike 92.1 from Madison Wisconsin was guest hosting. Near the end of the show for about 30 minutes, Mr. Rayburn talked about some anomalies he knew of in absentee ballots in Wisconsin. It seems that John McCain is sending absentee ballots to Obama supporters and listeners of progressive radio. Here is how the scam works. McCain sends out absentee ballots to Obama supporters. First the envelopes have "do not forward" on them (the usually caging strategy). Second, the return envelope does not go back to the town you are registered in, it goes to a town hundreds of miles away from where you live. That's right, your ballot goes to the wrong city and the wrong clerk so the ballot is then declared void. The owner of the radio station even got one!!! Mr Rayburn asked people to call if they had received any such letters. It turns out that people in California, Michigan, North Carolina received similar letters! There is even a scam for the snow birds that vote in Florida. They send the letter in the summer when most snowbirds are up north. When the letter comes back because it can't be forwarded, the republicans can now challenge the voter. Nice. I got the audio from the iTunes podcast of the Thom Hartmann show September 11, 2008.
